Terms of Use

PLEASE READ CAREFULLY. Section 15 contains a BINDING ARBITRATION agreement and a CLASS ACTION WAIVER that affect your legal rights. You may opt out of arbitration within 30 days. Sections 10, 11, and 12 limit our liability and describe risks you assume by using Caravan.

1. Acceptance of Terms

By downloading, installing, or using the Caravan mobile application and related services (the "Service"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. These Terms are a legally binding agreement between you and Caravan LLC ("Caravan," "we," "us," or "our"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use the Service only if a parent or legal guardian has reviewed and agreed to these Terms on your behalf and supervises your use. By using the Service, you represent that you meet these requirements.

We do not knowingly permit anyone under 13 to use the Service and will terminate accounts we believe belong to users under 13.

You also represent that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

3. Account Registration

To access most features you must create an account via Firebase Authentication. You agree to provide accurate information, keep your credentials secure, accept responsibility for all activity under your account, and notify us immediately of any unauthorized access at security@caravan-explore.com.

4. Use of the Service

You may use Caravan for personal, non-commercial outdoor adventure coordination. Commercial use — including use by guides, outfitters, tour operators, or fleet operators — requires our prior written permission. Contact legal@caravan-explore.com to request it.

You agree not to: use the Service for any unlawful purpose; harass, threaten, stalk, or harm other users; track or monitor any person without their knowledge and consent; upload illegal, infringing, or objectionable content; attempt unauthorized access to our systems or another user's account; scrape, reverse engineer, or decompile the Service; interfere with or overload our infrastructure; or impersonate any person or entity.

5. User Conduct and Objectionable Content

We have zero tolerance for objectionable content and abusive behavior. You may not post, upload, or transmit content that is unlawful, harassing, threatening, defamatory, obscene, sexually explicit, hateful, or that depicts or encourages violence, self-harm, or the exploitation of minors.

We provide in-app tools to report content and to block other users. We review reports and may remove content and suspend or permanently terminate offending accounts, at our sole discretion and without notice. Reports may also be sent to support@caravan-explore.com.

6. Assumption of Risk

Off-road driving, overlanding, and backcountry travel are inherently dangerous activities that can result in property damage, serious bodily injury, or death. Risks include vehicle rollover and mechanical failure, terrain and weather hazards, becoming stranded or lost, wildlife, and remoteness from medical care.

By using the Service, you acknowledge these risks and voluntarily assume them. You are solely responsible for your own safety, your vehicle, your passengers, and your group. You agree to release Caravan LLC from all claims arising out of the inherent risks of these activities.

7. Safety Features Are Not an Emergency Service

Caravan's safety features — including check-ins, monitored contacts, notification zones, overdue alerts, and live location sharing — are convenience tools only. You expressly acknowledge that:

8. Route, Map, and Trail Data

Routes, waypoints, trail information, and difficulty ratings are created by users or supplied by third parties. They may be inaccurate, incomplete, or out of date. Routes may cross private property, seasonally closed roads, restricted areas, or terrain beyond your vehicle's or your own capability.

You are solely responsible for verifying that any route is legal, open, permitted, and appropriate for your vehicle, skill level, and conditions before you travel it. Caravan does not endorse or verify any route.

9. Location Sharing and Voice Chat

By enabling location features, you consent to your location being shared with the participants of your active Caravan group and, where you have configured it, with your designated safety contacts. Only enable background location and location sharing when you intend to share your position.

By joining a voice session, you consent to your voice being transmitted in real time to the other participants. Recording other participants without their consent is prohibited and may be illegal in your jurisdiction.

10. User Content

You retain ownership of the content you submit, including photos, trip data, routes, and profile information ("User Content"). By submitting User Content, you grant Caravan LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for example, to compress images, generate thumbnails, or blur location coordinates), display, and distribute that content as reasonably necessary to operate and provide the Service.

This license ends when you delete your User Content or your account, except that content you have already shared with others — into a group, a scheduled journey, or a snapshot link — may persist in the copies held by those recipients, and we may retain server backups for a commercially reasonable period.

You represent that you have all rights necessary to submit your User Content and to grant this license.

11. Copyright and DMCA

If you believe content on the Service infringes your copyright, send a notice to our designated agent at dmca@caravan-explore.com including: your physical or electronic signature; identification of the copyrighted work; identification of the material claimed to be infringing and where it is located; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act.

We will remove infringing material and terminate repeat infringers.

12. Premium Features and Payments

Caravan offers a free tier and a premium tier, referred to in the App as "Signal Fires." It is offered as an auto-renewing subscription in two options:

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription automatically renews at the same price and duration unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription in your Apple ID or Google Play account settings. Deleting the App does not cancel your subscription. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Refunds are handled by Apple or Google under their policies, not by us. Prices may change; we will give you notice before a change takes effect.

13. Intellectual Property

All content, features, and functionality of the Service — excluding User Content — are owned by Caravan LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY LOCATION DATA, ROUTE DATA, ALERT, OR NOTIFICATION WILL BE ACCURATE, TIMELY, OR DELIVERED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARAVAN LLC AND ITS OFFICERS, MEMBERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING ANY FAILURE, DELAY, OR INACCURACY OF LOCATION SHARING, SAFETY ALERTS, OR ROUTE DATA — WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100 USD.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, so some of the above exclusions in Sections 14 and 15 may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Caravan LLC and its officers, members, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of the rights of any third party.

17. Termination

We may suspend or terminate your access at any time, with or without notice, for conduct that violates these Terms or that we reasonably believe is harmful to other users or to us. You may terminate your account at any time in the App settings. Sections 6, 7, 8, 10, 13, 14, 15, 16, 18, and 19 survive termination.

18. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution. Before filing a claim, you agree to contact us at legal@caravan-explore.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration. If we cannot resolve the dispute informally, any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Salt Lake County, Utah. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. You and Caravan agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate claims or preside over a representative proceeding.

Small Claims Exception. Either party may bring an individual claim in small claims court if it qualifies.

Injunctive Relief Exception. Either party may seek injunctive relief in court to protect intellectual property rights.

30-Day Opt-Out. You may opt out of this arbitration agreement by emailing legal@caravan-explore.com with your name, the email on your account, and a clear statement that you opt out of arbitration, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

Governing Law. These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.

19. Apple and Google

These Terms are between you and Caravan LLC only, not with Apple Inc. or Google LLC. Caravan, not Apple or Google, is solely responsible for the Service and its content.

Apple and Google have no obligation to furnish any maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Service.

Apple and Google are not responsible for addressing any claims you or a third party have relating to the Service, including product liability claims, claims that the Service fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Caravan is solely responsible for investigating and defending any third-party claim that the Service infringes intellectual property rights.

You agree that Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

20. General

Changes. We may update these Terms. Material changes will be communicated via in-app notification or email and posted with a new "Last updated" date. Continued use after the change takes effect constitutes acceptance.

Severability. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain in full force.

Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and Caravan regarding the Service.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including network or satellite outages, natural disasters, and acts of third-party providers.

Waiver. Our failure to enforce any provision is not a waiver of it.

Notices. We may send notices to the email on your account or via in-app notification. Send notices to us at legal@caravan-explore.com.
